Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Gemini Page Insights Chrome extension ("the Extension") operated by TheRealPourya ("the Developer", "us", "we", or "our").

Your access to and use of the Extension is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Extension. By accessing or using the Extension, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access or use the Extension.

1. License

Subject to these Terms, the Developer grants you a non-exclusive, non-transferable, revocable license to use the Gemini Page Insights extension for your personal, non-commercial use.

2. Functionality

The Extension uses Google's Gemini API to provide webpage summarization services. To use the Extension, you must:

• Obtain your own API Key for the Google Gemini API ("Gemini API Key").
• Agree to Google's terms of service and privacy policy regarding the use of their Gemini API.
• Input your Gemini API Key into the Extension's settings.

The quality, availability, and nature of the summaries provided are dependent on the Google Gemini API and the content of the webpages you summarize. The Developer does not guarantee the accuracy, completeness, or usefulness of any summary.

3. User Responsibilities

• API Key Security: You are solely responsible for obtaining and maintaining the security of your Gemini API Key. Do not share your API Key with others. The Developer is not responsible for any unauthorized use of your API Key.
• Compliance with Google's Terms: You agree to comply with all applicable terms and conditions set forth by Google for the use of the Gemini API. Any costs associated with your use of the Gemini API are your sole responsibility.
• Lawful Use: You agree to use the Extension only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this Extension by any third party.
• Content Responsibility: You acknowledge that the Extension processes content from webpages you visit. You are responsible for ensuring that your use of the Extension to summarize content complies with all applicable laws and respects intellectual property rights.

4. Intellectual Property

The Extension and its original content (excluding content from third-party libraries like Readability.js or content generated by the Gemini API), features, and functionality are and will remain the exclusive property of the Developer. The Extension is protected by copyright and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Developer.

Mozilla's Readability.js is included under its respective open-source license (Apache License 2.0).

5. Third-Party Services

The Extension relies on the Google Gemini API, a third-party service. Your use of this third-party service is governed by Google's terms and privacy policies. The Developer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

6. Disclaimer of Warranties

The Extension is provided on an "AS IS" and "AS AVAILABLE" basis. The Developer makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, the Developer does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the summaries generated by the Extension or otherwise relating to such materials or on any sites linked to this Extension. Summaries are generated by an AI model and may contain inaccuracies or errors.

7. Limitation of Liability

In no event shall the Developer be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Extension or the summaries it provides, even if the Developer or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Termination

We may terminate or suspend your license to use the Extension immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Changes to Terms

The Developer reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice through the Extension or by other means prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Extension after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Extension.

10. Governing Law

These Terms shall be governed and construed in accordance with international laws, without regard to its conflict of law provisions.
